have been forged or falsified. Where it is suspected that
a tax payer has deliberately sought to conceal or deceive or corrupt or to
conspire. Where a tax payer has used
documents that have either been forged or falsified. Where a tax payer has a
past record of tax offences and tax investigations, or a repeated period of
illegal activity. Where there are suspicions involving
individuals who occupy a position of trust such as members of the legal,
judiciary or accounting professions. Where it is suspected that
a tax advantage has been achieved by the misrepresentation of facts, or by
falsifying or forging documents. Where it is suspected that
the general tax base has been threatened or compromised as a consequence of a systematic
act of fraud, or fraud of a particular nature, or the sheer amount of tax
evaded Where it is suspected that an act of Conspiracy has been committed. If you are subject of a Criminal Investigation, it is important to remember that it will be conducted using the inherent powers of the Police and Criminal Evidence Act (PACE) and consequently, it is vital that you are appropriately represented.
Dependent on circumstances, H M Revenue and Customs might be persuaded to seek prosecution on a civil rather than criminal basis, providing that the inspectors can be convinced that full and complete disclosure will be made. This can be extremely difficult to achieve.
